The Local Rules Committee has recommended, and the judges of the Eastern District of Wisconsin have approved proposed changes to the Local Rules. Please see redline version for proposed changes.
- Civil Local Rule 12 pertains to the situation in which a defendant submits additional facts in support of a motion to dismiss or a motion for judgment on the pleadings. This has resulted in some confusion as to how the opposing pro se plaintiff is to respond. To alleviate any confusion, Civil Local Rule 12 is being removed from the Local Rules. When such motions are filed, the court will deal with the situation by use of a scheduling order.
- Civil Local Rule 54. The Clerk’s Office is preparing a Bill of Costs guide for attorneys to use when billing costs. To make our local rule regarding Costs compliant with current Seventh Circuit case law, the changes to Civil Local Rule 54 have been approved.
- Civil Local Rule 77 authorizes the Clerk to enter certain orders and judgments without further direction of the court. To avoid confusion, subsection (e) regarding extensions of time is being removed from the Clerk’s authority.
