Decision and Order

A jury rejected Farmers New World Life Insurance Co.’s rescission defense and awarded Joyce Williams $100,000 in damages for Farmers’s breach of a life insurance contract. The court rejected Williams’s post-verdict motion that she was entitled to the $150,000 face value of the policy in addition to the $100,000 in damages. The court also rejected Williams’s argument that she was entitled to attorney fees, expert witness fees, and interest.

The court determined that revenues derived from creating and maintaining e-procurement systems for nursing-home chains and their suppliers were not derived from licensing computer software and therefore were not deductible under former Section 199 of the Internal Revenue Code.
