Revised Procedures for Social Security Disability Appeals

Effective July 1, 2022 the Clerk of Court will effect service in all social security disability appeals.  Cases requiring service on or after that date are subject to the recently signed Memorandum of Understanding Regarding Service of Process which directs the Clerk of Court to provide email notification of the suit to the Commissioner and U.S. Attorney’s Office.  The email notification will be sent by the Clerk of Court via CM/ECF when the filing fee is paid or when the petition to proceed without prepayment of the filing fee is granted.

Unless otherwise advised by the Commissioner, service in accordance with Federal Rule of Civil Procedure 4(i) is not necessary.  

Please note that these new procedures apply unless otherwise ordered by the court.
