On April 10, 2023, the President signed a congressional resolution bringing to a close the national emergency response to the COVID-19 pandemic. Under Sections 15002 (a) and (b)(5) of the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), the court’s authorization to use video or teleconferencing technologies for any hearings other than those authorized by the Federal Rules of Criminal Procedure expired on Wednesday, May 10, 2023. In criminal cases, as of May 10, 2023, the court no longer has the authority to hold a variety of criminal hearings—including revocation, plea and sentencing hearings—by videoconference. For information about types of hearings that still may be conducted by videoconference (with the defendant’s consent made after advice from counsel) after May 10, 2023, see Fed. R. Crim. P. 5(g), 10(c), 40(d), 43(b)(2) and 53.

The court is aware that given the ongoing COVID-19 public health emergency, parties in civil litigation have and will continue to take depositions by remote means. To assist the parties in doing so in an effective and efficient manner, the court is providing parties with a form stipulation and proposed order regarding taking depositions via remote means in any civil litigation except pro se prisoner and pro se 1983 cases. The court encourages parties to work together to agree to remote deposition protocols, and to modify the stipulation and proposed order if necessary to reach agreement.
