When the court decides that a prisoner does not have the capacity to litigate a case on his or her own, the court will make efforts to find a volunteer attorney to represent the prisoner. First, the court posts a summary of the case on its website to make attorneys aware of current opportunities. Then, at the beginning of each month, the court emails a list of opportunities to attorneys who have recently appeared in the Eastern District of Wisconsin.

Effective March 15, 2021, and consistent with 28 U.S.C. §1915(b)(1), any prisoner who brings a civil action in forma pauperis will be required to pay the $350 statutory filing fee, even if the case is dismissed—voluntarily or by the court—prior to the court screening the complaint. Prisoners who cannot pay the full fee at once will be required to make monthly payments as described in §1915(b)(2).

Bankruptcy court’s decision denying real estate purchaser’s motion to enforce plan confirmation order against holder of right of first refusal was not legally or factually erroneous. The holder of the ROFR had not received sufficient notice to protect its interest before the property was sold; and because the purchaser knew or should have known of the defect in title, it could not claim bona fide purchaser status.
