Decision and Order

The court struck affirmative defenses that were not pleaded with the level of detail required by Heller Financial, Inc. v. Midwhey Powder Co., Inc., 883 F.2d 1286 (7th Cir. 1989). However, the court gave reasons for applying a relaxed pleading standard to affirmative defenses and concluded that the “plausibility” standard that applies to claims for relief does not apply to affirmative defenses.

NextGen CM/ECF Coming in April

The Federal Judiciary has developed a Next Generation (NextGen) Case Management/Electronic Case Files (CM/ECF) system that will allow attorneys to use the same account for both PACER and electronic filing access.

The District Court for the Eastern District of Wisconsin plans to upgrade to NextGen on April 8th, 2019.  For more information on NextGen, click here.
